Abstract
The set of rights, principles and rules in force in the European Union already allows us to speak of a body of legal institutions that can be qualified as a branch of the entire Community Law. However, the validity of the principle of subsidiarity, embedded in the system of the Treaties of the Union, augurs a long period before the consolidation of these legal structures. But the number and the qualitative entity of the labor and «social protection» rules (the latter can be described as ‘weak’ in their formulation and legal force) in force, as well as the intense activism of the case law of the Court of Justice of the European Union, increasingly called upon by the national social judges (notably through the claim of the preliminary ruling question) that question the national interpretative «status quo» (the dominance of the Supreme Court), allow us to affirm that the national legal systems are already unintelligible without them and their solid knowledge will be decisive for the success of the legal profession, not only, but also, of the work. Within this body of law, which already enjoys a certain «density», attention should be drawn to the special importance given in Community Law to the participation of workers in the company —recognized as a fundamental right in article 27 of the Charter of
Fundamental Rights of the European Union.
