Abstract

This paper examines the legal framework for occupational risk prevention liability in the context of outsourcing, particularly within large companies. Based on current legislation and recent case law, the study explores the scope of joint liability of the principal employer, with special focus on the concept of the «offending company». Finally, it considers whether recent Supreme Court rulings represent a refinement or a shift in judicial interpretation.
