Abstract
This study analyzes the Judgment núm. 78/2025 of the Spanish National Court, which upholds the lawfulness of prorated bonus calculation in cases of extended sick leave. The decision finds that such adjustments do not amount to unlawful changes to working
conditions or discrimination on grounds of health, provided they rely on objective and previously disclosed parameters. The study also reviews case law on non-collective incentive schemes, the principle of equality concerning illness, and the use of proportionality as a valid legal criterion for variable remuneration systems.
