Abstract
This commentary examines the decision of the High Court of Justice of the Basque Country (17 April 2024), which declared the dismissal of a physical trainer by Athletic Club as unfair. The ruling explores whether the employment should be considered a special
labour relationship under Royal Decree 1006/1985, concluding instead that it was a standard employment contract due to the worker’s performance of duties beyond the scope of sports practice.
