Abstract

This paper argues that, at present, political, economic, and social phenomena have emerged that are profoundly transforming the Union and its Member States. Specifically, it identifies several trends—geopolitisation, securitisation, and supranationalisation—that explain the emergence of a European law geared toward achieving new objectives: strategic autonomy, resilience, and defence. The impact of these changes, however, cannot be sufficiently and adequately grasped from a sectoral perspective, since they directly affect the foundations of European integration and the theory of the State. For this reason, with a heuristic aim, a new model of the state is proposed—the Strategic State—which transcends the established European image of the State as a regulator and guarantor. This State must be capable of acting strategically—anticipating, mobilizing, and utilizing all resources at its disposal—public and private, civilian and military—in order to confront existential threats, to preserve the values of democracy, rule of law and welfare State, and to ensure its capacity for autonomous action, free from external pressures.
