Abstract
The reflections of the philosophy of law about justice, preferably focus on concepts of social justice, there is no approach to the plot of justice in the trial and in the process. That is why Taruffo makes a great contribution to Latin America, by working with a marked difference, between what should be social justice and judicial justice. The first one that uses moral criteria, where social balances are the center of the discussion. The second, which results in a fair judicial decision, uses other discursive tools, sufficiently reasonable from the legal point of view, to define particular conflicts.
